IBERDROLA CLIENTES, S.A.U., an Iberdrola Group company, has its registered business address at Plaza Euskadi 5, Bilbao (Bizkaia), and is registered in the Companies Registry of Bizkaia in volume 5448, folio 19, page BI 63981, entry number 1, with company tax ID number A-95758389. The company is also authorised to market electricity and natural gas by the Directorate General for Energy Policy and Mining of the Ministry of Industry, Energy and Tourism.
Codes of conduct
IBERDROLA is a member of Autocontrol (Association for Self-regulation of Commercial Communication) and adheres to the Advertising Code of Conduct and the Code of Ethics for E-commerce and Interactive Advertising approved by that Association, which are available on its website www.autocontrol.es.
IBERDROLA and our employees are accountable to the internal rules on Corporate Governance and Code of Ethics, which, together with the information relating to compliance thereof, are available to the users on the website www.iberdrola.com.
I. GENERAL TERMS AND CONDITIONS OF ACCESS AND USE OF THE WEBSITE
IBERDROLA provides access to the website www.iberdrola.fr under the following conditions of use:
Access and users
Access to the website www.iberdrola.fr is granted to whomever does so under the condition of USER on express, full and unlimited acceptance by the USER of all these CONDITIONS OF USE, without prejudice to the specific conditions that may need to be applied in the event that a USER as a legal entity wishes to sign up for any of the goods and services on offer.
The Portal service is offered free of charge.
When a USER is required to provide personal details to be able to access any of the specific services, the provisions set forth in the chapter on Security and Protection of Personal Data shall apply to the collection and processing of such personal details.
Modification
In order to improve the features offered on the website, IBERDROLA reserves the right to modify, expand or temporarily discontinue the display, configuration, technical specifications, content and services on the website at any time, unilaterally and without prior notice.
It also reserves the right to amend these conditions of use or any other specific conditions contained on the website www.iberdrola.com at any time. Users will nevertheless be notified of such changes by corresponding notices on the website.

Conditions of use
The USER undertakes to make proper use of the content and services on www.iberdrola.fr, which may never be used for illegal activities or actions which may be contrary to public order, national defence or public health. Any use by the USER of the content and services must respect the principles stated in the paragraph above.
The USER is expressly authorised to display all the information contained on the website, as well as to make private copies of such information on the USER's computer systems so long as such content is for the USER's exclusive use and not transferred subsequently to third parties.
Intellectual and industrial property
The intellectual and industrial property rights to the content of the pages on the website www.iberdrola.fr, their graphic design and computer codes, as well as the trade names, trademarks and distinctive signs that appear therein, are owned by IBERDROLA, unless otherwise stated.

Exclusion of guarantees and responsibilities
Access to and use of www.iberdrola.fr will be done at the sole and exclusive liability of the USER.
IBERDROLA is not liable for the accuracy, veracity and validity of any information not prepared by the Company and whose content belongs to third-party information sources unrelated to the Company. In this regard, IBERDROLA shall only be liable for its own services and directly created content, identified by its Copyright as a trademark or intellectual or industrial property of IBERDROLA.
IBERDROLA neither guarantees nor assumes liability for damages of any kind arising from the following circumstances:
1. Lack of continuity in the operation of www.iberdrola.fr or malfunctioning of the pages on the website.2 Lack of usefulness, appropriateness or validity of the services and content offered on www.iberdrola.fr in relation to the USER's results and expectations.3 Existence of viruses or programmes on the USER's computer or presence of viruses in the services provided by third parties through www.iberdrola.fr.4 Knowledge by unauthorised third parties of the type, conditions, characteristics and circumstances of the USER's access to and use of the website and the information and services therein.5. Jurisdiction and applicable legislation
These Terms and Conditions of Use shall be governed under Spanish legislation.
In the event of any discrepancy or conflict in connection with the interpretation or application of these Conditions of Use or the website's content, in general, IBERDROLA and the USER expressly waive any other venue and submit to the jurisdiction of the courts of justice of the USER's place of residence. In the case of USERS resident outside of France, IBERDROLA and the USER expressly waive any other venue and submit to the jurisdiction of the courts of justice of the city of Bilbao.
II. SECURITY AND PROTECTION OF PERSONAL DATA
Privacy policy
The personal data provided to www.iberdrola.fr are protected under the pertinent Spanish legislation currently in force. The data are provided freely and voluntarily, and must be accurate and truthful.
At IBERDROLA CLIENTES, S.A.U., we implement all necessary measures to ensure the security and confidentiality of all data under our safekeeping at all times.
The data that users provide will be kept in the files of IBERDROLA CLIENTES, S.A.U., domiciled at Plaza Euskadi 5, 48011 Bilbao, for the purpose of managing requests.
Should the request include personal data relating to natural persons other than the individual making the request, the USER must inform them of the content of this clause prior to their inclusion in accordance with article 5.4 of the Personal Data Protection Act (Law 15/1999).
As provided for under the Personal Data Protection Act (Law 15/1999), Users may exercise the right to access, change, oppose and cancel personal data at any time by sending a letter addressed to the Oficina del Cliente, Apartado de Correos nº 1732, 28080 Madrid, or e-mail to Oficina_cliente_DICOM@iberdrola.es, stating, where pertinent, the contract data, identifying particulars, address and a copy of a valid identity document.
www.iberdrola.fr provides the possibility to request information and offers related to the supply of electricity and gas. The data provided through www.iberdrola.fr will be incorporated to the aforementioned file.
Consent for the use of electronic means in communications between clients and users
At Iberdrola, we want to guarantee that all business-related communications with our customers comply with legislation currently in force.
Therefore, in accordance with the Information Society Service and E-Commerce Act (Law 34/2002) and the General Telecommunications Act (Law 9/2014 of 9 May), we hereby inform you that Iberdrola may send information via electronic means about own or third-party products and services, whether energy-related or not, relating to the home, entertainment activities, telecommunications and financial services only when the USER has expressly authorised us to do so by providing data.
You may revoke this authorisation at any time by contacting Lssi@iberdrola.es or through the link enabled for this purpose in the commercial communications you receive.
Security measures
Access to the transactional pages through which the www.iberdrola.fr USER signs up for IBERDROLA products or services takes place in a secure environment. To confirm that you are at a website belonging to our Company, check that the words IBERDROLA appear in the upper status line. You can also check that you are in a secure environment by looking at the URL address shown in properties (clicking the right mouse button). The URL address begins with https", where the "s" shows that the contents are offered by a secure server.
III. ACCESS TO DATA RELATED TO ELECTRIC AND/OR NATURAL GAS CONSUMPTION1

Information on the characteristics and usefulness of data related to electricity or natural gas consumption that are made available
The Grid Operators of the Public Distribution Networks for electricity and/or gas shall implement features enabling suppliers to propose to their customers different prices at different times of the year or day and encouraging network users to limit their consumption during the periods when consumption by all consumers is the highest.
As part of the deployment of these features, the Grid Operators of the Public Distribution Networks for electricity and/or gas make available to consumers their metering data, alert systems linked to the level of their consumption, as well as comparative elements derived from statistical averages based on local and national consumption data.
Pursuant to Article L. 124-5 of the Energy Code (in French « Code de l'Energie »), they guarantee the possibility for suppliers to access consumption metering data, downstream of the meter and in real time, provided the consumer agrees to it.
The Grid Operators of the Public Distribution Networks for electricity and/or gas make available to the building property owner or manager - upon his request and if they can prove that they have implemented energy management measures on behalf of the building's consumers, the metering data in an anonymised and aggregated form to the building level. Costs resulting from the aggregation of the metering data shall not be charged to the consumer and may be charged to the property owner or manager of the building on a non-profit basis.

Access to this data is made available to the consumer on a secure area
When the consumer is fitted with a metering device that can be read remotely and is aligned with the definition stated above, IBERDROLA makes the following data available to the consumer in a secure area of its website:
1° The monthly indexes, specifying whether they are taken remotely or estimated;
2° The monthly and annual consumption, if applicable per tariff period, in kilowatt-hours (kWh) for electricity, in m3 (mètres cubes) and in kilowatt-hours with the conversion factor applied for natural gas;
3° The maximum electrical power withdrawn per monthly and annual period, in kilovolt-amperes;
4° Issued invoices ;
5° When applicable, data as mentionned to 3° of the article D. 224-27 of Consumption Code (Code de la Consommation) ;
6° As per consumer's request, the assessment as mentionned to article D. 224-29 of Consumption Code (Code de la Consommation) ;
7° A feature that allows the recovery of the data in all or in part in an electronic form as mentioned herein, in an open standard, easily reusable and exploitable by an automated processing system;
8° A feature allowing the request for deletion of the data as mentioned in the 3° of the article D. 224-27 of Consumption Code (Code de la Consommation) that has been recorded, when necessary, by IBERDROLA.
The provisions of 1° to 4° shall apply to energy consumption data relating to at least the last three years or the period since the start of the supply contract, if the latter is shorter.
IBERDROLA shall send the consumer the data mentioned in 1°, 2° and 3° for the last twelve months by post each year upon his request, without prejudice to the provisions of article D. 224-29 of Consumption Code (Code de la Consommation).
What are the functionalities of the secure area?
The secure area mentioned in article D. 224-26 of the Consumer Code (Code de la Consommation) includes functionalities allowing the consumer to ask IBERDROLA to transmit his requests to the Grid Operators of the Public Distribution Networks.
The activation of these functionalities therefore implies the transmission of the corresponding data to IBERDROLA and the consumer has then the possibility to access these data on a secure area made available by the Grid Operators of the Public Distribution Networks.
The consumer may choose to ask for :
1° With respect to the electricity load curve :
a) Stop its recording by the metering device ;
b) Delete the data recorded in this device
c) Collect or cease to collect it
d) Change the measurement time interval
e) Delete the collected data ;
2° To modify, when applicable, the operating mode of the meter device allowing local access to the consumption data it collects ;
3° To transmit or stop transmitting to IBERDROLA, the following data :
a) Daily remote indexes and daily consumption measured in kilowatt-hours (kWh) for electricity and in both m3 (mètres cubes) and kilowatt-hours (kWh) for natural gas, with the conversion factor applied ;
b) The maximum electrical power daily withdrawn, in kilovolt-amperes ;
c) The electricity load curve if its collection has been requested by the consumer.
The provisions of point 3 shall apply to energy consumption data related to at least the last 24 months or the period since the start of the supply contract, if the latter is shorter.
IBERDROLA acknowledges receipt of the above-mentioned requests on a sustainable support.

It should be noted that when the supply contract is signed and at least once a year thereafter, IBERDROLA informs the consumer on a durable medium that he/she can access his/her consumption data in the secure area provided by the Grid Operators of the Public Distribution Networks.
